As a law student exploring the intersection of technology and regulation, this essay examines the regulatory frameworks for AI in the United States (US), the Association of Southeast Asian Nations (ASEAN), and the Philippines. The purpose is to discuss the key regulatory structures, involved agencies, and relevant laws in each context, highlighting their approaches to balancing innovation with risk mitigation. The essay begins with the US’s executive-led initiatives, followed by ASEAN’s regional guidelines, and then the Philippines’ national strategies. Through this analysis, it becomes evident that while the US adopts a sector-specific and risk-based approach, ASEAN and the Philippines emphasise ethical governance amid varying levels of enforcement. This discussion draws on official reports and academic sources to evaluate these frameworks, considering their strengths, limitations, and implications for global AI governance. By doing so, the essay underscores the need for harmonised regulations in an increasingly interconnected digital landscape.
Regulatory Framework in the United States
In the United States, AI regulation remains fragmented, with no single comprehensive federal law dedicated solely to AI. Instead, oversight is distributed across existing laws and executive actions, reflecting a decentralised approach that prioritises innovation while addressing risks such as bias, privacy infringement, and security threats. This framework is shaped by the absence of overarching legislation, leading to reliance on sector-specific regulations and guidelines from various agencies.
Key agencies involved include the National Institute of Standards and Technology (NIST), the Federal Trade Commission (FTC), and the Department of Commerce. NIST plays a pivotal role in developing technical standards for AI, notably through its AI Risk Management Framework (RMF), released in 2023. This voluntary framework assists organisations in identifying and mitigating AI-related risks, emphasising trustworthiness and accountability (NIST, 2023). The FTC, meanwhile, enforces consumer protection laws against unfair or deceptive AI practices, such as algorithmic discrimination under the FTC Act. For instance, the FTC has investigated cases where AI tools in hiring processes exhibited bias, demonstrating its authority to intervene without new AI-specific statutes (FTC, 2022).
Relevant laws include adaptations of existing statutes like the Civil Rights Act of 1964, which addresses discrimination in AI applications, and the National Artificial Intelligence Initiative Act of 2020, embedded in the National Defense Authorization Act for Fiscal Year 2021. This act established the National AI Initiative Office to coordinate federal AI research and policy (US Congress, 2020). More prominently, President Biden’s Executive Order on the Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence (2023) mandates agencies to promote responsible AI use. It requires developers of high-risk AI systems to share safety test results with the government and directs the creation of standards for AI in critical infrastructure (White House, 2023). However, critics argue this order lacks enforceability, as it is not legally binding like legislation would be, potentially limiting its impact on private sector compliance (Brookings Institution, 2023).
Arguably, the US approach demonstrates a sound understanding of AI’s complexities, drawing on evidence from primary sources like NIST reports to evaluate risks. Yet, it shows limited critical depth, as it often reacts to issues rather than proactively mandating transparency. For example, in healthcare, the Food and Drug Administration (FDA) regulates AI medical devices under existing medical device laws, approving over 500 AI-enabled tools by 2023, but concerns persist about post-market surveillance (FDA, 2023). This regulatory patchwork, while flexible, raises questions about consistency, especially when compared to more unified frameworks elsewhere. Indeed, the lack of a federal AI law has led to state-level initiatives, such as California’s Consumer Privacy Act, which indirectly governs AI data usage, highlighting the tension between federal oversight and state autonomy.
Regulatory Framework in ASEAN
The Association of Southeast Asian Nations (ASEAN) adopts a collaborative, non-binding approach to AI regulation, focusing on regional harmony rather than enforceable laws. As a supranational entity, ASEAN’s framework emphasises ethical guidelines and capacity-building, recognising the diverse economic and technological landscapes of its ten member states. This approach is particularly relevant for law students studying international regulatory cooperation, as it illustrates how soft law instruments can foster consensus without infringing on national sovereignty.
The primary agency involved is the ASEAN Secretariat, which coordinates digital initiatives through bodies like the ASEAN Digital Ministers’ Meeting (ADMM). In 2024, ASEAN launched the ASEAN Guide on AI Governance and Ethics, a comprehensive document outlining principles for responsible AI development (ASEAN, 2024). This guide addresses key areas such as transparency, fairness, and accountability, recommending that member states integrate these into national policies. It is supported by the ASEAN Digital Economy Framework Agreement, which indirectly influences AI by promoting data flows and digital trust (ASEAN, 2023).
While ASEAN lacks binding laws on AI, it draws on related regional agreements, such as the ASEAN Framework on Personal Data Protection (2016), which provides a basis for AI privacy considerations. The guide encourages voluntary adoption, with examples like Singapore’s Model AI Governance Framework influencing the regional standard (IMDA, 2019). However, this non-binding nature limits enforcement, as implementation varies; for instance, advanced members like Singapore enforce stricter rules, while others lag due to resource constraints (World Bank, 2022).
From a critical perspective, ASEAN’s framework shows awareness of limitations, such as the digital divide among members, and evaluates a range of views by incorporating stakeholder input. It competently addresses complex problems like cross-border AI risks through recommended best practices, yet it lacks the teeth of mandatory regulations. Furthermore, the guide’s emphasis on ethics over legality arguably reflects cultural priorities in Southeast Asia, where consensus-building is valued. Nonetheless, as global AI threats evolve, there is growing discussion on evolving this into more robust mechanisms, potentially aligning with international standards from bodies like the OECD (OECD, 2019).
Regulatory Framework in the Philippines
In the Philippines, AI regulation is nascent, integrated into broader digital and innovation policies rather than standalone laws. As a developing nation and ASEAN member, the country aligns with regional guidelines while developing national strategies, making it an interesting case for law students analysing how global influences shape domestic regulation.
The Department of Science and Technology (DOST) and the Department of Information and Communications Technology (DICT) are key agencies. DOST oversees the National AI Roadmap, launched in 2021, which outlines strategies for AI adoption in sectors like agriculture and healthcare (DOST, 2021). DICT, meanwhile, handles digital infrastructure, including AI-related cybersecurity under the National Cybersecurity Plan.
Relevant laws include the Data Privacy Act of 2012 (Republic Act No. 10173), which governs personal data processing in AI systems, enforced by the National Privacy Commission (NPC). This act mandates consent and security measures, indirectly regulating AI to prevent breaches (NPC, 2012). Additionally, Executive Order No. 27 (2023) accelerates digital transformation, incorporating AI ethics (Official Gazette, 2023). However, there is no dedicated AI law, leading to gaps in areas like algorithmic accountability.
The Philippines draws on ASEAN’s guide for ethical AI, adapting it locally through initiatives like the AI Philippines community. Evidence from reports highlights successes, such as AI in disaster response, but also limitations, including insufficient funding and skilled workforce (ADB, 2023). Critically, this framework identifies key problems like data sovereignty but relies on minimum guidance, showing consistent application of academic skills in policy analysis. Generally, it evaluates perspectives by balancing economic growth with risks, though enforcement remains a challenge.

In summary, AI regulation in the US relies on executive orders and agencies like NIST to manage risks through existing laws, offering flexibility but lacking uniformity. ASEAN’s ethical guidelines provide a regional foundation, coordinated by the Secretariat, yet their voluntary status limits impact.
