However, alongside their undeniable benefits, these platforms have become breeding grounds for misinformation, posing significant risks to public discourse, health, and democracy. This essay, written from the perspective of an English studies student exploring digital communication, examines whether social media companies should be legally or ethically obligated to curb misinformation. It considers the arguments for mandatory intervention, the challenges of enforcement, and the potential impact on free expression. Ultimately, the essay argues that while social media platforms should take responsibility for addressing misinformation, a balanced approach is necessary to avoid overreach and protect fundamental rights.
The Case for Mandating Action Against Misinformation
Misinformation on social media can have profound real-world consequences, particularly during crises. For instance, during the COVID-19 pandemic, false claims about vaccines and treatments proliferated online, contributing to vaccine hesitancy and public health challenges. Research by Wardle and Derakhshan (2017) highlights how misinformation, often amplified through algorithms, can outpace factual content due to its emotive appeal. Requiring platforms to intervene—through content moderation, fact-checking, or algorithm adjustments—could mitigate harm by prioritising verified information. Moreover, governments and regulatory bodies, such as the UK’s Department for Digital, Culture, Media and Sport, have increasingly called for accountability, arguing that platforms like Facebook and Twitter profit from engagement-driven models that inadvertently promote falsehoods (DCMS, 2019). From this perspective, mandating action seems not only justified but essential to safeguard societal well-being.
Challenges and Limitations of Enforcement
Despite the compelling case for intervention, enforcing anti-misinformation measures presents significant obstacles. Firstly, defining ‘misinformation’ is inherently problematic; what constitutes falsehood can be subjective, especially in political or cultural contexts. Indeed, overzealous regulation risks stifling legitimate debate or dissenting opinions. Secondly, the sheer volume of content on platforms makes comprehensive monitoring near-impossible without advanced artificial intelligence, which often struggles with nuance and context (Gillespie, 2018). Furthermore, there is the issue of jurisdiction; social media operates globally, yet regulatory frameworks differ widely. For instance, while the UK government proposed the Online Safety Bill to combat harmful content, enforcing compliance across borders remains complex (DCMS, 2021). Thus, mandating action, while desirable, may be impractical without international cooperation and clear guidelines.
Balancing Responsibility with Freedom of Expression
Arguably, the most critical concern is the potential threat to free speech. If platforms are compelled to police content, they might err on the side of caution, censoring lawful material to avoid penalties. This could disproportionately affect marginalised voices or alternative perspectives, undermining the democratic potential of social media (Gillespie, 2018). A balanced approach, perhaps involving collaboration between platforms, independent fact-checkers, and regulators, might better address misinformation without curtailing rights. Platforms could also educate users on media literacy, empowering them to discern credible sources—an approach supported by Wardle and Derakhshan (2017). Such strategies, though less immediate, may prove more sustainable.

As digital communication continues to evolve, striking this balance will be crucial to protect both public welfare and freedom of expression.
